One-to-One Online Experiences — Italian BreakPast Srls

Italian BreakPast Srls offers the possibility to purchase, through its website, online experiences ("Experiences") delivered as a one-to-one video call with one of the restaurant’s chefs.
The content, duration, price and any other specific feature of each Experience are indicated on the relevant product detail page published on the website, which the Customer reviews and accepts at the time of purchase. These Terms apply to all Experiences offered, in addition to what is specified on the detail page of each individual product.
The Experience is delivered through a video call platform built on Agora SDK technology. At the time of purchase, the Customer selects the desired date and time among the available slots.
Following the purchase, the Customer receives an order confirmation by email containing the booking summary and the access link to the video call, which will automatically activate on the selected date and time.
The Experience is delivered through a proprietary platform built on Agora SDK technology. It is the Customer’s sole responsibility to have, at the time of the call:
Italian BreakPast Srls cannot be held responsible for malfunctions, interruptions or reduced service quality caused by connection issues, device problems or technical configuration attributable to the Customer.
The price of each Experience is indicated on its product detail page on the website at the time of purchase, VAT included where applicable. Payment is due in full at the time of booking, through the payment methods indicated on the website.
Given the nature of the service — a performance delivered at a specific date and time agreed upon by the parties — the following policy applies, which the Customer expressly accepts at the time of purchase:
If the Experience cannot be delivered for reasons attributable to Italian BreakPast Srls (for example: chef unavailability, platform technical issues), the Customer will be entitled to a full refund of the amount paid, including any transaction fees, regardless of the timing of the cancellation. Alternatively, a free rescheduling may be offered, at the Customer’s choice.
Under Italian consumer law (Article 59, paragraph 1, letter n) of the Consumer Code, Legislative Decree 206/2005 — implementing Directive 2011/83/EU), the statutory right of withdrawal does not apply to contracts for the supply of services related to leisure activities where the contract provides for a specific date or period of performance. As the Experience is delivered on a specific date and time agreed at the time of purchase, it falls within this exception. Accordingly, only the cancellation policy set out in section 5.1 applies.
Refunds due under section 5 are issued using the same payment method used for the purchase, within a reasonable time and in any case no later than 14 business days from the date the request is accepted.
Italian BreakPast Srls reserves the right to modify the timing, duration or technical delivery method of the service for organisational reasons, promptly notifying the Customer.
Content, recipes and teaching materials shared during the Experience are for the Customer’s personal use only and may not be reproduced, distributed or used for commercial purposes without the prior written consent of Italian BreakPast Srls.
These Terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the Court of Bologna, unless the Customer qualifies as a consumer under the Consumer Code, in which case the competent court shall be that of the consumer’s place of residence or domicile, if located within Italian territory.
Purchase of the Experience is conditional upon reading and expressly accepting these Terms and Conditions, to be confirmed via a dedicated checkbox (not pre-ticked) at checkout. Without such acceptance, the purchase cannot be completed.
